Release of Liability

RELEASE OF LIABILITY

WAKESPORT WARNING, ASSUMPTION OF RISK, RELEASE OF LIABILITY & INDEMNIFICATION AGREEMENT PLEASE READ CAREFULLY BEFORE SIGNING. THIS IS A RELEASE OF LIABILITY & WAIVER OF LEGAL RIGHTS. 

1. Definitions. The person who is participating in a wakesport competition or any WWA event shall be referred to hereinafter as “Participant”. The “Undersigned” means only the Participant when the Participant is age 18 or older OR it means both the Participant and the Participant’s parent or legal guardian when the Participant is under the age of 18. “Released Parties” means: The World Wakeboard Association (WWA), their sponsors, event organizer(s), site owner/lessee or any of their respective successors in interest, affiliated organizations and companies, insurance carriers, agents, employees, representatives, competition officials, assignees, officers, directors, members, and shareholders. The “Activity” means taking part in wakeboarding competition or any WWA event, and using the wakesport facilities or boats for any purpose. 

2. Risks of Activity. The Undersigned agree and understand that taking part in the Activity can be HAZARDOUS AND INVOLVES THE RISK OF PHYSICAL INJURY AND/OR DEATH. The Undersigned acknowledge that the Activity is inherently dangerous and fully realize the dangers of participating in the Activity. The risks and dangers of the activity include, but are not limited to: actual or alleged transmission of communicable disease such as COVID-19, negligence of Participant, water conditions, water flow, tides, currents, wakes, collisions with other participants, watercraft and other manmade and natural objects, weather conditions, capsizing, sinking, exposure to elements, slips and falls, equipment failure and/or defects, operator error, mental distress from exposure to any of the above, and negligence of others. THE UNDERSIGNED ACKNOWLEDGE AND UNDERSTAND THAT THE DESCRIPTION OF THE RISKS LISTED ABOVE IS NOT COMPLETE AND THAT PARTICIPATING IN THE ACTIVITY MAY BE DANGEROUS AND MAY INCLUDE OTHER RISKS. FURTHER PARTICIPANT AGREES THAT PRIOR TO PARTICIPATING, PARTICIPANT WILL INSPECT THE FACILITIES AND EQUIPMENT TO BE USED, INCLUDING PARTICIPANT’S OWN EQUIPMENT, AND IF PARTICIPANT BELIEVES ANYTHING IS UNSAFE WILL IMMEDIATELY ADVISE HIS/HER COACH OR SUPERVISOR AND A COMPETITION OFFICIAL, IN WRITING OF SUCH CONDITION(S) AND REFUSE TO PARTICIPATE. 

3. Release, Indemnification, and Assumption of Risk. In consideration of the Participant being permitted to participate in the activity, the Undersigned agree as follows: 

(a) Release. THE UNDERSIGNED HEREBY IRREVOCABLY AND UNCONDITIONALLY RELEASE, FOREVER DISCHARGE, AND AGREE NOT TO SUE OR BRING ANY OTHER LEGAL ACTION AGAINST THE RELEASED PARTIES with respect to any and all claims and causes of action of any nature whether currently known or unknown, which the Undersigned, or any of them, have or which could be asserted on behalf of the Undersigned in connection with the Participant’s participation in the Activity, including, but not limited to claims of negligence, breach of warranty, and/or breach of contract. 

(b) Indemnification. The Undersigned hereby agree to indemnify, defend and hold harmless the Released Parties from and against any and all liability, cost, expense or damage of any kind or nature whatsoever and from any suits, claims or demands, including legal fees and expenses whether or not in litigation, arising out of, or related to, Participant’s participation in the Activity. Such obligation on the part of the Undersigned shall survive the period of the Participant’s participation in the Activity. 

(c) Assumption of Risk. The Undersigned agree and understand that there are dangers and risks associated with the participation in the Activity and that INJURIES AND/OR DEATH may result from participating in the Activity, including, but not limited to the acts, omissions, representations, carelessness, and negligence of the Released Parties. By signing this document, the Undersigned recognize that property loss, injury and death are all possible while participating in the Activity. RECOGNIZING THE RISKS AND DANGERS, THE UNDERSIGNED UNDERSTAND THE NATURE OF THE ACTIVITY AND VOLUNTARILY CHOOSE FOR PARTICIPANT TO PARTICIPATE IN AND EXPRESSLY ASSUME ALL RISKS AND DANGERS OF THE PARTICIPATION IN THE ACTIVITY, WHETHER OR NOT DESCRIBED ABOVE, KNOWN OR UNKNOWN, INHERENT, OR OTHERWISE.

4. Minor Acknowledgment. In the case of a minor Participant, the Undersigned parent or legal guardian acknowledges that he/she is not only signing this Agreement on his/her behalf, but that he/she is also signing on behalf of the minor and that the minor shall be bound by all the terms of this Agreement. Additionally, by signing this Agreement as the parent or legal guardian of a minor, the parent or legal guardian understands that he/she is also waiving rights on behalf of the minor that the minor otherwise may have. The Undersigned parent or legal guardian agrees that, but for the foregoing, the minor would not be permitted to participate in the Activity. By signing this Agreement without a parent or legal guardian’s signature, Participant, under penalty of fraud, represents that he/she is at least 18 years of age. If signing as the parent or guardian of a minor Participant, signing adults represent that they are a legal parent or guardian of the minor Participant.

5. Medical Care. Undersigned authorize the Released Parties and/or their authorized personnel to call for medical care for Participant or to transport Participant to a medical facility or hospital if, in the opinion of such personnel, medical attention is needed. Undersigned agree to pay all costs associated with such medical care and related transportation.

6. Miscellaneous. The Undersigned further agree and understand: (a) Participant will not engage in any activities prohibited by any applicable laws, statutes, regulations and ordinances; (b) this Agreement shall be governed by the laws of the State of Florida and the exclusive jurisdiction and venue for any claim arising out of this Agreement shall be the state courts located in Polk County, Florida and Undersigned expressly agree and consent to jurisdiction in said courts; (c) Participant grants to WWA, the non-exclusive right to use Participant’s name or likeness in any photographs, television or motion pictures taken of Participant during, training, competition, demos, or other WWA event for the purpose of EVENT promotion; (d) This Agreement constitutes the entire agreement between the parties hereto and supersedes any and all prior contracts, arrangements, communications, or representations, whether oral or written, between the parties relating to the subject matter hereof; and (e) the Undersigned understand and acknowledge that this Agreement is a contract and shall be binding to the fullest extent permitted by law. If any part of this Agreement is deemed to be unenforceable, the remaining terms shall be an enforceable contract between the parties. It is the intent of the Undersigned that this agreement shall be binding upon the assignees, subrogors, distributors, heirs, next of kin, executors and personal representatives of the Undersigned.

I HAVE CAREFULLY READ THE FOREGOING ASSUMPTION OF RISK, RELEASE OF LIABILITY & INDEMNIFICATION AGREEMENT AND UNDERSTAND ITS CONTENTS. I AM AWARE THAT I AM RELEASING LEGAL RIGHTS THAT OTHERWISE MAY EXIST.

MALIBU BOATS AND THE WWA ANNOUNCE TENTH SEASON OF RIDER EXPERIENCE SERIES

LAKE ALFRED, FL (January, 14, 2022) – The World Wake Association (WWA) and Malibu Boats are excited to announce the return of the world’s premier amateur development event series with five stops of action for the 2022 Malibu WWA Rider Experience Series for the tenth year. This season, amateur riders across the U.S. will come together yet again alongside the top Malibu Pro athletes for a weekend focused on the next generation in wake through family-friendly instruction and competition in a laid-back atmosphere that is open to participation from all who are interested. The WWA and Malibu are excited to showcase the sport’s growing talent and continue the exponential growth of the sport as the Rider Experience series heads into its monumental season. 

“It’s been incredible to watch the Malibu Rider Experience series grow since its inception in 2013. These events truly encompass what makes our sport so special, bringing together old friends, new families, and brand-new riders into the sport. Our educational and rider development programs both on and off the water give competitors and parents a unique opportunity to take their understanding of what judges are looking for to the next level. We’re thrilled to celebrate ten years of growing the sport with Malibu this season,” said WWA President, Shannon Starling.

Since 2013 the Malibu Rider Experience has hosted thousands of riders from first-timers to those making the transition to pro, while building local and national wake communities that fully encompass the spectrum of the sport that makes wake unlike anything in its path. Continuing the great feedback in 2021, the Jr. Pro Women’s division alongside the Jr. Pro will continue to be as the main event of each WWA Wakeboard Regional Championship with $20,000 in travel scholarships divided equally towards the WWA Wakeboard National Championships for the top overall series finishers in each division.  


Each weekend will again kick off with ‘Shreddin’ Saturdays’ featuring freeriding for wakeboarding and wakesurfing, product demos, instruction from Malibu Pro athletes and a Judges Experience. This fully inclusive day of all things wake will provide the opportunity for the entire family, friends, and neighbors alike to familiarize themselves with the course, receive tips on the water and in the boat, and test out the industry’s latest products. The WWA Regional Championships and Pro Card Qualifiers will be held on Sunday giving amateur riders the chance to compete with riders in their region and qualify for the WWA Wakeboard National Championships and aspiring pros the opportunity to earn professional status.

Continuing on the success seen the past two seasons, the final stop of the series will finish in the eastern region in Smithville, TN for the Rider Experience East in conjunction with Tennessee Wakefest. The top finishers from each region in all divisions will receive special invites to compete at Wakefest which will serve as the grand finale of the 2022 Rider Experience series.

Malibu Boats dealers in each region will host the WWA Rider Experience events beginning on the west coast and working its way across North America. Information and registration can be found by visiting  TheWWA.com/RiderExperience.
 
All athletes must compete in their respective WWA Regional Championship to be eligible for the 2021 WWA Wakeboard National Championships (boat only).

All riders must hold a current WWA Pro Card to register in the pro division at any WWA wakeboard event. The top 15 riders on the 2021 WWA Wakeboard World Rankings list will retain their Pro Card for the 2022 season. All other riders must obtain their Pro Card at one of six qualifying events. 2022 WWA WAKE PARK WORLD CHAMPIONSHIPS PRESENTED BY NAUTIQUE BOATS HOSTED BY LIQUID LEISURE, HOME OF PLASTIC PLAYGROUNDS

Lake Alfred, Florida (January 10, 2022):  The World Wake Association (WWA) and Liquid Leisure are excited to announce 2022 WWA Wake Park World Championships presented by Nautique Boats is heading to one of the most iconic and progressive wake parks in the World, Liquid Leisure Windsor in the U.K. With Liquid Leisure and it’s Plastic Playgrounds event being widely respected by the athletes, this Wake Park World Championship event is no doubt set to be one of the most anticipated wake park events of the season.
